Sing the Day

Terms of Service

Last updated October 6, 2026

The short version

  • Sing the Day makes a personalized, AI-generated birthday song from your answers, for a one-time $9.99.
  • The song is for personal use: play it, download it, share it with the birthday person and post it on your own social media. Don’t sell it or use it commercially.
  • Not quite right? You get two free remakes. Our Refund Policy explains when you get your money back.
  • You must be 18 or older, or have a parent’s or guardian’s permission, to buy a song.

Who we are

Sing the Day is based in the United States. In these terms, “we” and “us” mean Sing the Day, and “you” means the person using the site or buying a song. By using the site or buying a song, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the site.

Who can buy

You must be 18 or older to buy a song, or have the permission of a parent or guardian who agrees to these terms for you.

What you’re buying

A personalized birthday song, made from the answers you give in our form: the birthday person’s name, your relationship to them, a few details about them, and the feeling, style and voice you pick. The price is shown before you pay ($9.99 at the time of writing) and is charged once, in US dollars. There’s no subscription.

Your song is delivered within 24 hours of payment: we email you a link to your song page, along with a gift link you can send to the birthday person.

Every song comes with two free remakes, made one at a time from your song page. A remake that can’t be made doesn’t count toward your two. Every version stays on your song page, and you choose which one your gift link plays.

How the songs are made

Songs are made by artificial intelligence. We send your answers to Anthropic, whose AI model writes the lyrics, and then to ElevenLabs, whose AI music model composes and sings the song. No human musician writes or sings your song.

AI music can surprise you: a name may be sung a little differently than you expect, or a line may not come out as written. That’s what the free remakes are for. Because every song is generated fresh, we can’t promise a particular result, and a song may sound similar in style to other music.

What you can put in a song

You’re responsible for the answers you give us. Please only make a song about someone you have a genuine reason to celebrate, and don’t submit anything that:

  • is hateful, harassing, threatening, or meant to humiliate someone;
  • is sexual and involves a minor in any way;
  • infringes someone else’s rights, such as lyrics or a trademark you don’t own;
  • is about someone you have no reasonable basis to write about;
  • is otherwise illegal.

We may refuse to make a song, or cancel an order, that breaks these rules.

Using your song

Once you’ve paid, we give you a personal, non-exclusive license to use your song. You may:

  • play it and download it as often as you like;
  • share it with the birthday person, and with friends and family;
  • post it on your personal social media accounts.

You may not:

  • sell or license it, or use it in ads or for any other commercial purpose;
  • upload it to music streaming or distribution services, or register it with a content ID or royalty service;
  • claim that you, or anyone else, wrote or performed it.

Anyone who has your gift link can listen to the song, so share it only with people you want to hear it. Your song page link is just for you: it also holds your remakes and your birthday reminder.

Payments and refunds

Payments are processed by Stripe; we never see your full card number. If something goes wrong with your song, our Refund Policy explains what we do about it.

Using the site

Please don’t misuse Sing the Day: no attempts to break into it, overload it, or get songs without paying. We work to keep the site running, but we can’t promise it will always be available or free of errors, and we may change or stop parts of it.

Disclaimer

Except as these terms and our Refund Policy say, the site and the songs are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.

Limitation of liability

To the extent the law allows, we aren’t liable for any indirect, incidental, special or consequential damages, and our total liability for any claim about the site or a song is limited to the amount you paid for that song.

Nothing in these terms limits rights you have under US consumer protection laws, or other laws, where those laws say they can’t be limited.

Governing law

These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. The terms in place when you bought a song apply to that purchase.
